Terms and Conditions

This is a translation provided for convenience. The German version of these terms and conditions is the legally binding one.

1. General

Unless expressly agreed otherwise, our terms and conditions apply to all business between Learn2ride Snowboardschule Oberhof and its customers. The object of the business is the operation of a snow sports school (snowboard school). This includes in particular services such as teaching the skills and knowledge of snowboarding (without any guarantee of a particular level of success) as well as guiding and accompanying people while snowboarding.

Learn2ride Snowboardschule Oberhof is entitled to collect, store and process the personal data of the customer required within the scope of the business relationship. If a group falls below 4 participants, we reserve the right to merge groups or to shorten the number of teaching hours.

2. Conclusion of contract for offers, online price enquiries and prices

Reservations for snowboard courses can be made online or by telephone. Reservations are only considered firmly booked once confirmed in writing by Learn2ride Snowboardschule Oberhof. Offers made by Learn2ride Snowboardschule Oberhof are without obligation. Our written order confirmation alone is decisive for the acceptance of the reservation and the scope of the service.

Verbal or telephone side agreements only apply if expressly confirmed in writing by Learn2ride Snowboardschule Oberhof. All prices stated by us are in euros including statutory VAT. Price lists are without guarantee. No liability is accepted for printing errors.

3. Payment terms

Unless other written agreements have been made, for online bookings concluded via the internet or other means of distance communication, the respective course fee is payable immediately upon receipt of the written order confirmation. You can pay by bank transfer and PayPal. All services provided by Learn2ride Snowboardschule Oberhof on the basis of online orders via the internet or other online services are subject to these terms and conditions. The transfer must be made within 5 days and must be credited to the account of Learn2ride Snowboardschule Oberhof at least three banking days before the start of the lesson. For contracts concluded at the place of performance, the fee for the service to be provided is payable directly on site. In the event of late payment by the customer, we are entitled to charge default interest of 5 % per year; claims for compensation for higher interest remain unaffected.

4. General conditions of participation

The contracting party must inform Learn2ride Snowboardschule Oberhof truthfully and fully about their snowboarding abilities and experience, and must independently ensure that their equipment meets current technical standards and the external conditions. They must also fully inform Learn2ride Snowboardschule Oberhof about their physical abilities, in particular their state of health and any complaints.

Before lessons begin, the contracting party must arrange for their equipment to be checked. Taking part in services of Learn2ride Snowboardschule Oberhof under the influence of alcohol or drugs entitles us to terminate the contract immediately. The contracting party must follow the instructions given to them by Learn2ride Snowboardschule Oberhof. Disregarding a warning entitles Learn2ride Snowboardschule Oberhof to terminate the contract immediately.

Learn2ride Snowboardschule Oberhof decides how groups are divided in snowboard courses. Should it be necessary to move a participant to a lower group, the contracting party must accept this decision. Otherwise Learn2ride Snowboardschule Oberhof is entitled to terminate the contract. In the cases of contract termination described above, the contracting party has no claim to a refund of the fee paid.

During the courses, photographs and video recordings are regularly made for the purposes of documentation, for producing keepsake photos for the participants, and for the marketing purposes of Learn2ride Snowboardschule Oberhof (for example website, social media). By booking a course, the contracting party agrees to the creation and use of this material free of charge. An objection to this use can be raised with the snowboard school at any time before recording begins.

Learn2ride Snowboardschule Oberhof declines any liability for accidents that occur during or before lessons. Accident and personal liability insurance is the responsibility of the participants and is recommended. Refunds are only given in the case of injury or illness and only with medical confirmation from a locally based doctor.

4.1. Rental equipment

By renting the equipment, the hirer accepts the following conditions:

1. The rental equipment must be checked for visible defects. In the event of defects there is an obligation to exchange the item. Subsequent complaints will not be considered.
2. The lender is not liable for accidents that happen to the hirer or that are caused by the hirer.
3. The hirer is liable for lost or stolen rental equipment.
4. Any hirer who keeps the borrowed items for 8 days beyond the agreed period without informing the lender will be reported for misappropriation.
5. Every day is charged in full.
6. In poor weather there is no claim to a refund of rental fees paid in advance.

5. Liability provisions:

As a matter of principle, Learn2ride Snowboardschule Oberhof is liable under the statutory provisions exclusively for damage that is directly connected with the activity of Learn2ride Snowboardschule Oberhof and that was caused intentionally or through gross negligence. Corresponding liability insurance is in place.

6. Warranty:

The contracting party must report any complaints on site without delay so that remedial action can be taken. If notification is culpably omitted, there is no claim to a reduction of the fee. Claims against Learn2ride Snowboardschule Oberhof must be asserted and substantiated in writing no later than 4 weeks after they arise.

7. Cancellation

For private lessons, cancellation of the contract is possible until 12:00 noon on the previous day without a cancellation fee being incurred. A cancellation fee of 10% of the order value is charged. If cancellation is made at a later point in time, Learn2ride Snowboardschule Oberhof is entitled to charge 50% of the order value.

With regard to group courses, a refund of payments already made is only possible in the event of an accident, on presentation of the original receipt and with a medical certificate from a locally based doctor. The amount to be refunded is recalculated on the basis of the services actually provided for that period.

In the event of cancellation during an ongoing service or failure to appear at the agreed appointment, no refund will be given. If weather conditions do not allow the service to be carried out safely, Learn2ride Snowboardschule Oberhof reserves the right to postpone or cancel the services. Courses cancelled due to weather conditions (force majeure) will not be compensated.

9. Place of jurisdiction

The court with subject-matter jurisdiction at the registered office of Learn2ride Snowboardschule Oberhof has exclusive jurisdiction over all disputes arising from this contract.

10. Choice of law

German law applies.

11. Severability

Should individual provisions of these terms and conditions be invalid, this does not affect the validity of the remaining provisions or of the legal transaction as a whole. The invalid provision is to be replaced by one that comes economically closest to the invalid provision.
